Welcome to Write Your Lawmaker ("we," "us," "our," or the "Service"). By accessing or using our website at writeyourlawmaker.com and our related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on our website with an updated "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
2. Description of Service
Write Your Lawmaker provides a platform that enables users to compose, print, and mail letters to federal and state legislators and other government officials. Our Service includes:
- Letter composition tools and templates
- A directory of federal and state lawmakers
- Professional printing services
- Mailing and delivery services to lawmakers' offices
- Delivery tracking and confirmation
- Optional autopen signature simulation
- Bulk sending capabilities
3. User Accounts
To use certain features of our Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Immediately notify us of any unauthorized use of your account
You must be at least 13 years of age to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
4. User Content and Conduct
You retain ownership of the content of your letters. However, by using our Service, you grant us a limited license to print, process, and mail your letters as necessary to provide the Service. You grant a further license for other users to view and copy your letters if you make them public.
You agree that your letters will not:
- Contain threats, harassment, or intimidation of any kind
- Include hate speech, discriminatory language, or incitement to violence
- Contain false, misleading, or defamatory statements
- Violate any applicable federal, state, or local laws
- Infringe on the intellectual property rights of others
- Contain obscene, pornographic, or inappropriate content
- Include unsolicited commercial advertisements or spam
We reserve the right to review letters and refuse to print or mail any letter that violates these Terms or applicable law. If we refuse to process a letter after payment, we will provide a refund.
5. Letter Processing and Delivery
Once you submit and pay for a letter:
- We will print your letter within 1-3 business days
- Letters are printed professionally in the United States
- We will mail letters via USPS First Class Mail with tracking
- Delivery typically occurs within 3-7 business days after mailing
- You can track your letter's status through your account dashboard
We are not responsible for delays caused by:
- United States Postal Service delays or failures
- Incorrect lawmaker addresses (we use the most current public records available)
- Government office closures or disruptions
- Force majeure events beyond our reasonable control
6. Public Letters and Gallery
You may choose to make your letters public, allowing them to be viewed by other users in our gallery or browse features. By making a letter public, you:
- Grant us a perpetual, worldwide, royalty-free license to display your letter content
- Acknowledge that other users may view and read your letter
- Understand that you can change a letter's visibility from public to private at any time
- Agree that we may feature public letters in promotional materials
Letters are private by default. We will never make your letters public without your explicit consent.
7. Intellectual Property
The Service, including its software, design, text, graphics, logos, and other content (excluding user letters), is owned by Write Your Lawmaker and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or create derivative works of our Service
- Reverse engineer or attempt to extract source code
- Use our trademarks or branding without written permission
- Frame or mirror any part of our Service
- Use automated systems to access the Service without permission
8. Third-Party Services
Our Service integrates with third-party services including payment processors and postal services. Your use of these services may be subject to their own terms and conditions. We are not responsible for the actions or policies of third-party service providers.
9. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free from viruses or harmful components
- Your letters will achieve any particular result or response from lawmakers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months prior to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Write Your Lawmaker, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- The content of your letters
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Letters already paid for and in process will be completed unless termination is due to your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the State where our company is registered, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Political Neutrality
Write Your Lawmaker is a neutral platform. We do not endorse, support, or oppose any political party, candidate, policy position, or viewpoint expressed in user letters. We serve users of all political persuasions equally.
The views expressed in letters are solely those of the users who create them and do not reflect the views of Write Your Lawmaker.
14. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and Write Your Lawmaker regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
